A DWI case may be over, but that does not always mean it has stopped affecting you. Maybe the charge was dismissed years ago. Perhaps you went to trial and were found not guilty. You may still see the arrest or charge when you look at your record and wonder why it is there at all.
North Carolina generally calls the offense DWI rather than DUI. Whether you can clear the record depends mostly on how the case ended. A dismissed charge is treated differently from a conviction. At the Law Office of Dewey P. Brinkley, we can look at the court record and tell you what North Carolina law allows.
In most cases, you cannot expunge a DWI conviction in North Carolina. That is an important distinction because other misdemeanor convictions may qualify for expungement after certain requirements are met. Impaired-driving convictions are excluded from those rules.
So if you pleaded guilty to DWI or were found guilty, the age of the conviction does not automatically make it eligible. You may see websites that say misdemeanors can be cleared after a waiting period. That advice can be misleading when the conviction involves impaired driving. If you are not sure how your case was recorded, we can pull the court information and review the actual outcome before discussing what you can do.
A dismissal gives you a different set of options. If the prosecutor dismissed the DWI charge, North Carolina law may allow you to expunge the related criminal record. Depending on when the case ended, some eligible dismissals may already have gone through an automatic expungement process.
Older cases may require you to file a petition. A case with several charges may also need a closer look. For example, one count may have been dismissed while another ended in a conviction. Do not assume that because the DWI disappeared from your active court case, every record connected to the arrest disappeared too.
A not-guilty verdict may also qualify for expungement. You went to court, the state presented its case, and you were not convicted. Even so, the arrest and charge may still appear in records unless you complete the expungement process. That can be frustrating when you have to explain a case you won.
An expungement can clear qualifying records tied to an arrest or criminal charge. For someone whose DWI was dismissed or ended in a not-guilty verdict, that may make background checks less complicated. You may no longer have to keep explaining why an old DWI charge appears even though you were never convicted.
An expungement does not necessarily erase every mention of the case from every private database or internet search result. It also doesn’t automatically fix every driver’s license issue connected to the original DWI case. The safest approach is to find out exactly what still appears on your record and what can legally be cleared.
Start with a few basic facts. How did the DWI case end? When was it resolved? Were there other charges in the same case? Have you ever filed for an expungement before? Those details can tell us a lot.
At the Law Office of Dewey P. Brinkley, we can review the court record and your criminal history before telling you whether you qualify for an expungement. If you qualify, we can handle the filing and guide you through the process.
If the law does not allow the DWI conviction to be expunged, we will tell you that too. You should know where you stand before spending time and money on a petition that cannot succeed.
At the Law Office of Dewey P. Brinkley, we help clients in Raleigh and Wake County with DWI cases, expungements, and other criminal matters. If your old DWI charge was dismissed or you were found not guilty, it may be possible to clear the related record. You do not have to figure out the eligibility rules on your own.
